CNN —When he was president, Donald Trump tried to make the Supreme Court his own. In a video earlier this month, Trump announced his campaign position on abortion, including his personal thanks – one-by-one – to the Supreme Court justices who had voted against the 1973 Roe v. Wade milestone. Lower court judges ruled against Trump, saying whatever immunity he might have enjoyed as president ended when he left office. Beyond the substance of cases, Roberts and Trump clashed memorably when Trump in 2018 disparaged a US trial judge in partisan terms. Supreme Court conservatives are accelerating their moves to overhaul the way the federal government protects Americans, whether from air pollution or unfair financial practices. The case has determined a swath of court judgments on agency policy, well beyond the environmental realms, and become one of the most cited rulings in Supreme Court history. The Corner Post is protesting a Federal Reserve rule adopted in 2011 that caps debit card fees merchants obtain with every transaction. Three Republican-led states and power industry groups turned to the high court, seeking immediate relief and asking that any implementation be barred. Kagan focused on the multiple preliminary issues that lower court judges would have typically assessed before the case reached the justices.

Not since the 2000 case of Bush v. Gore has the Supreme Court been in the middle of an election battle of such potential magnitude. Several of the justices’ spouses, including Jane Roberts, wife of the chief justice, sat in a special guest session. Roberts’ criticism of the Colorado Supreme Court decision barring Trump was echoed by his colleagues, even as they varied in their constitutional grounds. Just as Roberts can set the tone for oral arguments, the chief justice presides over their private votes on cases. As he strives for consensus, Roberts is likely to try to keep any separate, concurring opinions to a minimum.

Now, the US Supreme Court faces its greatest test so far from the former president. How Trump works the refsEven though Trump is not expected to attend Thursday’s oral arguments at the Supreme Court, the justices know what’s coming. Mitchell joined the case on behalf of Trump around the time arguments were underway at the Colorado Supreme Court. Georgetown’s Supreme Court Institute, for instance, relies heavily on attorneys who have served in the US solicitor general’s office, the government’s top lawyers before the Supreme Court. (The Institute, which operates on a non-partisan basis and offers its sessions for free, declined to comment on the Trump case arrangement.) Particularly valuable for any moot court, along with former members of the solicitor general’s office, are former Supreme Court law clerks. In that November 2021 controversy, the Supreme Court allowed Mitchell 10 minutes as an an intervenor on the Texas side.

The new filings in the case of Trump v. Anderson also reinforce the tight world of Supreme Court lawyering. From the start, the Colorado voters trying to keep Trump off the ballot, and who won at the state Supreme Court level, have been represented by former US Supreme Court clerks who’ve become prominent advocates. CNN —The Colorado voters trying to disqualify Donald Trump from the state ballot told the Supreme Court on Friday that the violence the former president provoked on January 6, 2021, qualifies as an insurrection under the terms of the Constitution and bars him from holding future office. In the early pages of their 60-page filing, they also countered Trump lawyers’ warning of the “bedlam” that could follow if the justices were to allow states to block his name from upcoming primary ballots. The voters’ lawyers wrote that the mob “infiltrated the (US Capitol) building through shattered windows” and “erected gallows” outside, while chanting “Hang Mike Pence.” They noted that video of the day was on file at the court. The Supreme Court agreed earlier this month to hear the case of Trump v. Anderson, accepting the former president’s appeal of the Colorado Supreme Court decision that removed him from that state’s ballot. The Colorado trial judge disagreed, and her findings were upheld by Colorado’s high court, which concluded that he “intended that his speech would result in the use of violence.”

Reversal of the so-called Chevron deference approach was a priority for the judicial selection team that served Trump – on par with some right-wing activists’ quest for reversal of constitutional abortion rights. The reconstituted Supreme Court delivered on that agenda item in 2022 when it overturned Roe v. Wade. Former White House counsel Don McGahn, who controlled Trump’s judicial selections, regularly touted the administration’s anti-regulation agenda. He was especially drawn to the first two Trump appointees, Neil Gorsuch and Brett Kavanaugh, for their records in that regard. In his written brief and during arguments, Martinez invoked an adage of Chief Justice Roberts from his 2005 confirmation hearings, that judges serve as umpires, just calling balls and strikes.

Her memoir was, appropriately, entitled: “Are You Tough Enough?”Her son Neil Gorsuch, a Supreme Court justice since 2017, has shown his own brand of defiance and anti-regulatory fervor. In recent years, Justice Gorsuch has voted against regulations that protect the environment, student-debt forgiveness and Covid-19 precautions. He has led calls on the court for reversal of a 1984 Supreme Court decision that gives federal agencies considerable regulatory latitude and that, coincidentally traces to his mother’s tenure. The lawyers who will argue on behalf of the challengers are seasoned appellate advocates who once served as Supreme Court law clerks, as did Solicitor General Prelogar. That argument has prevailed in courts for decades, but the Supreme Court has signaled that it is ready for a new era.

CNN —When the Supreme Court left for its summer recess in June, the justices were at a stalemate on adopting a formal ethics code. Chief Justice John Roberts has been seeking unanimity among the nine justices for firm ethics standards, CNN has learned, but such agreement has eluded him. He told the WSJ writers that he was speaking out to defend himself and the Supreme Court because “nobody else” would. “Even assuming that trip is somehow relevant to present concerns about Supreme Court ethics, the connection is highly attenuated, focused on ‘an object remote’ from purported ‘legitimate concerns’ about ethics standards,” Rivkin wrote. A separate Associated Press investigation recently focused on liberal Justice Sonia Sotomayor’s use of Supreme Court staff to coordinate and promote the sale of her books.

The news Tuesday is that the US Supreme Court squarely rejected the fringe legal theory by which far-right activists and supporters of Trump hoped to be able to ignore election outcomes. What exactly did the Supreme Court do? The case at hand – Moore v. Harper – had to do with a 2022 North Carolina congressional map rejected by the state’s Supreme Court. Bush would win the White House over Al Gore, Supreme Court documents released on Tuesday show. Washington CNN —The recent revelations of lavish gifts and travel that a Republican megadonor showered on Justice Clarence Thomas reflect a larger Supreme Court culture of nondisclosure, little explanation, and no comment. The incident reflects the broader lack of accountability at the high court regarding off-bench behavior. Justices regularly brush aside reporters’ queries for specifics on travel and gifts, book advances and other extracurricular activities. Senate Judiciary Committee Chairman Dick Durbin made another such plea to Roberts this week as he also urged the chief justice to open an investigation into Thomas’ conduct. Chief justice on the spotRoberts, who became chief justice in 2005, has continually described the high court as beyond the realm of politics and worthy of public trust.
